1、Contract P arty A _Round Table Academy wishes to en gage the service of P arty B _ as an En glish Teacher. The two p arties, in a sp irit of frien dly coop erati on, agree to sig n this con tract and pl edge to fulfill con scie ntiously all the obligati ons st ipu lated in it. The p eriod of service

2、 will be from the ay of _ The work time of Party B will be accord ing to the regulati on of P arty A from _ Additi onal work time for Party B shall be allocated by Party A in adva nee. P arty A has the right to adjust the work ing hours accord ing to the n eeds of the school but the total work ing h

3、ours will not be exceeded as stated in the con tract. Party A s obligations 1. 2. 3. 4. 5. Party A shall in troduce to Party B the laws, decrees and releva nt regulati on en acted by the Chinese government and shall not interfere in China s internal affairs. Party B shall observe Party A swork syste

4、m and regulations and shall accept Party A s arran geme nt, direct ion, sup ervisi on and evaluati on in regard to his/her work. Without Party A consent, Party B shall not ren der service elsewhere or hold con curre ntly any p ost un related to the work agreed on with Party A. Party B shall compi et

5、e the tasks agreed on schedule and guara ntee the quality of work. Party B shall respect China seligious p olicy, and shall not con duct religious activities incomp atible with the status of a teacher. Party B shall resp ect the Chin ese people rdsTOoTdilaUanidms. Revisi on, Can cellati on, Termin a

6、tio n and Ren ewal of the Con tract 1. 2. 3. (1) Both p arties should abide by the con tract and should refrain from revis ing, can celi ng, or term in ati ng the con tract without mutual consent. The con tract can be revised, can celed, or term in ated with mutual consent. Before both p arties have

7、 reached an agreeme nt, the con tract should be strictly observed. Party A has the right to cancel the con tract immediately with a writte n no tice to Party B un der the follow ing con diti ons: Party B does n ot fulfill the con tract or does not fulfill the con tract obligati ons accord ing to the

8、 terms sti pu lated, and has failed to ame nd after Party A has poin ted it out. Accord ing to the doctor diag no sis, Party B cannot resume no rmal work after a con ti nued 30 days sick leave. Party B is abse nt without request twice or more duri ng the desig nated con tract. Party B is found traff

9、icking in any time during his/her work period or is intoxicated during work ing hours. Party B is un der the in flue nee of illegal substa nces or po ses risk of safety to the working en vir onment. Party B has failed to follow any of the regulati ons of this con tract and to maintain pro fessi onal

10、 con duct un til his/her con tract expires or comp lete. If Party B has failed to maintain and improve his/her working attitude, failed to act upon directives, and failed to improve his/her p erforma nee or other misc on duct(s). The dismissal will be in sta nt for any actio n deemed un acce ptable

11、by Party A. Party A reserves the right to term in ate this con tract in the event of incomp ete nee or violati ons aga inst the employment regulatio ns by Party B . 30 days adva need no tice is requiredPferty A must termi nate the con tract. This con tract will be con sidered to be termi nated if th

12、e nu mber of stude nts of Party B decreased more tha n 1/3. Party B is required to fulfill this con tract. His/Her failure to do so for any reas on will result in a compensation for RMB5000. 30 days advaneed notice is required iParty B must leave the post. Form of notice under 30 days will result in

13、 a penalty of RMB3000; however, advaneed notice over 30 days will not resulted in compensation. During this 30 days advaneed notice period, Party B shall still p erform his/her duties as sp ecified in the con tract. His/Her failure to do so will result in ano ther pen alty of RMB5000. In the event o

14、f dismissal, Party B will receive his/her wage up to but not in cludi ng the work ing day of dismissal, exclud ing all app licable pen alties. 7. The ren ewal of the con tract every year will be based upon the teachi ng p erforma nee, working attitude, seniority, and annual evaluation of Party B and

15、 on the student re-enrollment rate concerning the teacher. The appen dix of this con tract is an insep arable part of the con tract and has equal effect. This con tract takes effect on the date sig ned by both p arties and will automatically expire when the con tract en ds. If either of the two p ar

16、ties asks for a new con tract, it should forward its request to ano ther party 90 days p rior to the exp iratio n of the con tract, and sig n the new con tract with mutual consent. 4. 5. 6. Arbitratio n The two p arties shall con sult with each other and mediate any dis pu tes which may arise about

17、the con tract. If all atte mpts fail, the two p arties can app eal to the orga ni zati on of arbitrati on for foreig n expert s affairs in the State Adm ini strati on of Foreig n Exp erts Affairs and ask for a final arbitrati on. Required to prepare less on plans, stude nts evaluati on P arty B will reimburse the fees after P arty A p rovides the receipts to the man ageme nt w

Party B will be respon sible the visa app licati on, medical check up and all other p rocess ing fees if Party B is not qualify to apply and Party A will not be respon sible for any kind of visa app licati on. The fee for work p ermit or Foreig n Expert will be p aid b

20、y company so long as P arty B works for Party A for at least one year. While it shall be kept by P arty A and be returned to Party B as the employment en ds. If leav ing with in one year, Party B will pay back the fee at a certa in percen tage to Party A accord ing to the len gth of work ing mon th.

21、 Part B is required to sign in and out for work on time. Every 5 minutes lateness will result in a RMB25 reduct ion. This reduct ion will be doubled if such a situatio n occurs 2 or more times duri ng a mon th. Being late for 30mins or more will be con sidered as an hour abse nee and more tha n an h

22、our will result in a reduct ion in salary the equivale nt of 2 hours compen sati on for every sin gle hour. Party B will not be p aid duri ng semester break, but n ati onal holidays in China. Holidays P arty B will be give n all statutory holidays as p aid holidays. Should Party B be asked to work d

23、uri ng those Holidays, he/she will be compensated in the form of extra paid holidays to take at a time mutually agreed upon by Educati on Sup ervisor and Party B. Statutory holidays in clude Nati onal day, Chin ese New Year (also referred to as Spring Festival) and Labor Day. Sick and Personal Leave

24、 1. 2. 3. Party B requires personal leave of absenee; he/she must submit a leave request from at least 3 days prior to taking time off. A leave request form should be submitted at least one month in advanee if Party B requires personal leave for more than 3 consecutive days, and he/she is respon sib

25、le for finding a substitute teacher app roved by Party A. For sick leave, P arty B must tele phone the Teach ing Director at least 12 hours before work and fill in the form later. In case the leaves exceed 30 days, Party A has the right to term in ate the con tract. P arty B is allowed 2 sick days w

26、ithout deducti on of salary duri ng the p eriod of employment. Doctor s certificate is required. Extra sick days are not paid and Party A reserves the right to deduct an amount from Party B ssalary for each additional day that Party A is absent from work. Person al leave of P arty B shall be approve

27、d by Party A. P arty A will deduct the salary by day .In the contract term, the person al leaves should not exceed10 days, otherwise party A won give Part B the compi ete reward of RMB0- RMB500. The continu ous person al leave shall be no more than 3 days, and 2 days salary will be deducted for each

28、 day thereafter excluding vacation un - p aid leave. In case of absenee from work with out Part y A s permission, 3 days salary will be deducted for each day abse nt. For serious circumsta nces, P arty A has the right to termi nate the con tract and in vestigate the liability of the empio yed party

Party B will n ot disclose in formatio n concerning the work content without the written p ermissi on of Party A. Party B is required to follow the teacher uide and the teaching plans which

30、his/ her should familiarize him/ herself with before class, and if n ecessary, no tes may be used duri ng the less on. Being found readi ng the less on plan in class or not follow ing the less on plan will result in a forfeiture of an hour s wage for that class. Chan ges to the less on plan may only

31、 be made after con sultati on with the Teachers director. Party B is required to desig n curriculum p la n a week before and give it to the Teacher Director on time. Party B is not allowed to en gage in selli ng of any p roducts or services to the parents or staff of Party A. Party B is not allowed

32、to p rovide any tutori ng service to the childre n or families atte nding Party A school. The cop yright of any activity plans or tapes writte n/ made by Party B duri ng the worki ng time bel ong to Party A. Party B is required to up hold the Con fide ntiality of all asp ects of Party A. The en tire

33、 less on plans, docume nts and resources are commercial in tellectual prop erties of P arty A and p rotected by law, Legal proceeding will be taken against Party B if he/she uses or offers anyone any part of the above-me ntio ned software or in tellectual property any where bey ond the school of Par

34、t A. Party B is required to up hold all Party A s prop erties taanthesfeoiokdie , less on p la n, compu ter, la ptops Any damage or loss will result in equivale nt comp ersati on of the prop erty (for exa mp le, for each Happy Marian lesson p la n, RMB1000). Party B should kee p con fide ntial of th

35、e in formati on related to wage and must not en ter into discussi ons about this in formati on. Party A has the right to term in ate the con tract and in vestigate the liability of the empio yed p arty for violati on. Party B should set a good exa mple for colleagues whilst p rotect ing the company

Party B is required to watch and in teract with stude nts duri ng p laytime. Due to safety concerns he/she is not allowed to take recess o

37、r spend time chatt ing to other teachers. Party B is required to help stude nts with their sn acks and lunch everyday. He/She is also exp ected to help wak ing stude nts betwee n pm 2:002:10 whe n he/she has classes in the after noon. Party B is required to compi ete com mun icati on book and Biweek

38、ly Report for each stude nt. The report must be han ded in to the teach ing director by Thursday of every alter nate week. Failure to hand the report in on time will result in a fine of RMB100. Brain storm ing for less on plans and prep arati on for class (such as applying for materials) should be done 2 weeks ahe
